SALES AGREEMENT
DISTANCE SALES AGREEMENT – PRE-INFORMATION FORM
ARTICLE 1 – PARTIES

The above address and e-mail information shall be used for any complaints, objections and/or applications submitted by the BUYER, in their capacity as a consumer, regarding the SELLER.
ARTICLE 1.2 – BUYER
The person registered as a customer on www.goldanalytixturkiye.com.
The address and contact information provided during registration shall be taken as the basis.
ARTICLE 2 – CHARACTERISTICS OF THE PRODUCT SUBJECT TO THE AGREEMENT
The basic characteristics of the product are available at www.goldanalytixturkiye.com. The basic characteristics of the product can be reviewed throughout the campaign period.
The prices listed and announced on the website are the sales prices. The announced prices and related preliminary announcements remain valid until updated or changed by the Seller. Prices announced for a specific period remain valid until the end of the stated period.
The product information consists of the type, quantity, brand/model, color, quantity, sales price, payment method and the information available at the time the order is completed.
Before completing the order, the BUYER may correct any potential errors displayed on the "Order Summary" page by using the "Back" and "Change" options available on the website.
If the BUYER selects a future delivery date, all shipping costs related to the shipment of the product shall be calculated according to the delivery location and reflected on the BUYER's invoice by the SELLER under the name "Shipping Fee", except for any difference in shipping fees arising between the order date and the shipping date that is to be borne by the SELLER. Such shipping fees shall be paid by the BUYER and shall not be refundable.
ARTICLE 3 – GENERAL PROVISIONS
Although payment for the products covered by this Agreement may be made or will be made by credit card, debit card (including cards offering installment options), bank transfer or EFT, the nature of the Agreement is a cash sale.
Therefore, if the BUYER chooses to pay by bank transfer/EFT, the BUYER agrees and undertakes to transfer the order amount to the SELLER's bank account within one hour of placing the order. If the BUYER fails to transfer the order amount within one hour, the order shall be cancelled by the SELLER.
The BUYER acknowledges and declares that they have read, understood and electronically confirmed the preliminary information regarding the basic characteristics of the product, the sales price including all applicable taxes, the payment method, delivery terms, delivery costs to be borne by the BUYER, the delivery period, and the full commercial name, address and contact details of the SELLER on www.goldanalytixturkiye.com.
By electronically confirming this Preliminary Information Form, the BUYER confirms that, prior to entering into the distance sales agreement, they have accurately and completely received the information required to be provided by the SELLER, including the company name, MERSIS number, address, contact details, basic characteristics of the products ordered, exceptions to the right of withdrawal, circumstances in which the right of withdrawal cannot be exercised, prices including taxes, payment information and delivery information.
The product subject to the Agreement shall be delivered to the BUYER, or to the person/entity designated by the BUYER, within the period specified in the preliminary information available on the website, depending on the distance of the BUYER's place of residence, provided that this period does not exceed the statutory period of 30 (thirty) days.
If the product is to be delivered to another person or entity at the request of the BUYER, the SELLER shall not be held responsible if the relevant person or entity refuses to accept the delivery.
The SELLER shall not be held responsible for failure to deliver the ordered product to the BUYER for any reason arising from problems encountered by the shipping company during delivery.
The SELLER is responsible for delivering the product subject to the Agreement in good condition, complete, in accordance with the specifications stated in the order and, where applicable, together with warranty certificates, user manuals and certificates.
The SELLER reserves the right to supply the BUYER, before the fulfillment period expires, with a different product of equal quality and price.
If the SELLER is unable to fulfill its obligations under the Agreement because the supply of the ordered product becomes impossible or due to justified or valid reasons, the SELLER shall notify the BUYER, in their capacity as a consumer, within 3 (three) days from the date on which it becomes aware of the situation and shall refund the total amount paid within 10 (ten) days.
Delivery of the product subject to the Agreement is conditional upon the BUYER electronically confirming this Preliminary Information Form and paying the purchase price using the selected payment method. If the product price is not paid for any reason or the payment is cancelled in the bank records, the SELLER shall be deemed released from its obligation to deliver the product and from all related obligations.
If, after delivery of the product, the BUYER's credit card is used fraudulently or unlawfully by unauthorized persons without fault or negligence on the part of the BUYER, and the relevant bank or financial institution fails to pay the product price to the SELLER in full and on time, the product must be returned to the SELLER within 3 (three) days, provided that it has been delivered to the BUYER.
In such a case, transportation costs and all necessary expenses shall be borne by the BUYER. If the BUYER fails to return the product, the BUYER irrevocably accepts, declares and undertakes that, if the product price cannot be collected from the credit card for any reason, the product price shall be immediately and fully transferred to the SELLER's bank accounts without the need for any further notice.
For payments made by credit card, the product amount shall be refunded to the relevant bank within 7 (seven) days following cancellation of the order by the BUYER.
The time required for the refunded amount to appear in the BUYER's account is entirely dependent on the commercial procedures and processing times of the relevant bank. The BUYER acknowledges that the SELLER cannot intervene in any delays and that the amount refunded to the credit card by the SELLER may take approximately 2 (two) to 3 (three) weeks to appear in the BUYER's account. In all cases, such matters are subject to the procedures of the relevant bank, and the BUYER must contact the relevant bank directly regarding such claims.
ARTICLE 4 – RIGHT OF WITHDRAWAL
The BUYER, acting as a consumer, may exercise the right of withdrawal within 14 (fourteen) days from the date on which the goods are received by submitting written notice or notice through a permanent data storage medium to the SELLER.
The BUYER may exercise the right of withdrawal by using the withdrawal form available on the website or by making an explicit statement declaring the decision to withdraw from the Agreement.
The consumer may submit the withdrawal notice to the address or e-mail address specified in Article 1.1 in a manner that enables verification of their identity.
The consumer must return the goods to the SELLER or an authorized person within 14 (fourteen) days from the date on which the consumer communicates the exercise of the right of withdrawal.
The current list of shipping companies that may be used by the consumer to return the goods can be found on www.goldanalytixturkiye.com.
ARTICLE 5 – PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED
Pursuant to the Distance Contracts Regulation, unless otherwise agreed by the parties, the consumer may not exercise the right of withdrawal in the following contracts:
a) Contracts relating to goods or services whose prices fluctuate depending on developments in financial markets and which are not under the control of the seller or service provider.
b) Contracts relating to goods prepared in accordance with the consumer's wishes or clearly personalized needs.
c) Contracts relating to the delivery of goods that may deteriorate quickly or expire.
ç) Contracts relating to the delivery of goods whose protective elements such as packaging, tape, seals or packages have been opened after delivery, where return of the goods is unsuitable for reasons of health or hygiene.
d) Contracts relating to goods which, after delivery, become mixed with other products and cannot be separated due to their nature.
e) Contracts relating to books, digital content and computer consumables supplied in a tangible medium where protective elements such as packaging, tape, seals or packages have been opened after delivery.
f) Contracts relating to the delivery of periodicals such as newspapers and magazines, except where supplied under a subscription agreement.
g) Contracts relating to accommodation, transportation of goods, car rental, food and beverage supply, and leisure activities for entertainment or recreation that must be performed on a specific date or during a specific period.
ğ) Contracts relating to services performed instantly in an electronic environment or intangible goods delivered instantly to the consumer.
h) Contracts relating to services which have commenced with the consumer's consent before the expiry of the withdrawal period.
ARTICLE 6 – DELIVERY TERMS
Except where the BUYER requests a future delivery date, orders shall be handed over to the shipping company within 3 (three) business days, Monday through Friday, following bank authorization.
Depending on the distance of the delivery address from the Istanbul / Kuyumcukent location, the shipping company shall deliver the order within 1–3 business days.
No deliveries are made on public holidays or religious holidays.
Delivery periods for specially manufactured products vary depending on the production period. Delivery information and estimated delivery times for such products are specified on the relevant product pages.
All selected products shall be delivered through our contracted shipping companies.
The products purchased will be confirmed to the BUYER by e-mail. If any of the selected products are not currently in stock, the BUYER will be notified by e-mail and informed of the earliest planned date on which the product is expected to be restocked.
www.goldanalytixturkiye.com is an online shopping website that allows multiple users to shop simultaneously. In rare cases where multiple consumers purchase the same product at the same time, a product may become out of stock.
If a product that has already been paid for online is no longer available in stock, the BUYER may be required to wait for a minimum of 4 (four) and a maximum of 30 (thirty) days.
If the product cannot be supplied and shipped to the consumer within this period, the amount paid by the BUYER shall be refunded. Shipping costs shall not be refunded.
Before signing the shipping/delivery report, please check whether the package has been damaged during transportation.
If the shipping package is damaged for any reason, please do not sign any delivery documents and return the package to the courier so that an official damage report can be prepared.
A replacement product will then be dispatched to you as soon as possible.
If a damaged shipping package is accepted by the BUYER, www.goldanalytixturkiye.com and AGADIGITAL ELEKTRONİK MAĞAZACILIK VE TİCARET ANONİM ŞİRKETİ shall not be responsible for any damage to or missing contents of the product inside the package.
ARTICLE 7 – COMPETENT COURTS
In the implementation of this Preliminary Information Form, where the BUYER is a consumer, Consumer Arbitration Committees and Consumer Courts located at the place where the BUYER purchased the goods or services and/or where the BUYER resides shall have jurisdiction up to the monetary limits announced by the Ministry of Trade of the Republic of Türkiye.
The SELLER may submit complaints and objections to the Consumer Arbitration Committee or Consumer Court at the place where the goods or services were purchased or where the SELLER resides, within the monetary limits determined annually by the Ministry of Trade of the Republic of Türkiye.
For disputes exceeding these monetary limits, an application to a mediator is required before filing a lawsuit pursuant to Article 73/A of the Consumer Protection Law. Following the mediation process, the dispute may be brought before the Consumer Court or, where no Consumer Court exists, before the Civil Court of First Instance acting in the capacity of a Consumer Court.

ARTICLE 2 – SUBJECT MATTER
The subject matter of this Agreement is to regulate the rights and obligations of the parties in relation to the sale and delivery of the product ordered electronically by the BUYER from the SELLER's website, www.goldanalytixturkiye.com, in accordance with the provisions of Turkish Law No. 6502 on Consumer Protection, the Distance Contracts Regulation and Turkish Law No. 6563 on the Regulation of Electronic Commerce.

If the BUYER chooses bank transfer/EFT, the order amount must be transferred to the SELLER's bank account within one hour of placing the order. If payment is not received within one hour, the order shall be cancelled.
The BUYER acknowledges that they have read and understood the preliminary information regarding the product's basic characteristics, sales price including taxes, payment method, delivery conditions, delivery costs, delivery period, and the SELLER's full commercial name, address and contact information on www.goldanalytixturkiye.com.
By electronically confirming this Agreement, the BUYER confirms that they have received all required information accurately and completely prior to entering into the distance sales agreement.
The product subject to this Agreement shall be delivered to the BUYER, or to the person/entity designated by the BUYER, within the period specified in the preliminary information on the website, provided that the statutory maximum period of 30 (thirty) days is not exceeded.
The BUYER may choose a delivery date of 7, 14 or 21 days after the order date.
If the BUYER requests delivery at a later date, any difference in shipping costs arising between the payment date and the date on which the products are handed over to the carrier for delivery shall be borne by the SELLER.
If the product is to be delivered to another person or entity at the request of the BUYER, the SELLER shall not be responsible if the relevant person or entity refuses to accept the delivery.
The SELLER shall not be held responsible for failure to deliver the ordered product due to any problems encountered by the shipping company during delivery.
The SELLER is responsible for delivering the product in good condition, complete, in accordance with the specifications stated in the order and, where applicable, together with warranty certificates, user manuals and certificates.
The SELLER reserves the right to supply a different product of equal quality and price before the fulfillment period expires.
If the SELLER cannot fulfill its obligations because the supply of the ordered product becomes impossible or due to justified or valid reasons, the SELLER shall notify the BUYER within 3 (three) days of becoming aware of the situation and refund the total amount paid within 10 (ten) days.
Delivery is conditional upon the BUYER electronically confirming this Agreement and paying the purchase price using the selected payment method.
If the product price is not paid for any reason or the payment is cancelled in the bank records, the SELLER shall be deemed released from its obligation to deliver the product and all related obligations.
The BUYER irrevocably accepts, declares and undertakes that the credit card information entered into the system during the purchase is accurate and valid and that all legal and criminal liability arising from the use of this credit card belongs to the BUYER.
In the event that the credit card is unlawfully used by a person other than the cardholder, the provisions of Turkish Law No. 5464 on Bank Cards and Credit Cards and the relevant Regulation shall apply.
If, after delivery of the product, the BUYER's credit card is used unlawfully by unauthorized persons without fault or negligence on the part of the BUYER, and the relevant bank or financial institution fails to pay the product price to the SELLER in full and on time, the product must be returned to the SELLER within 3 (three) days.
In such a case, all transportation and related expenses shall be borne by the BUYER.
If the BUYER fails to return the product and the product price cannot be collected from the credit card for any reason, the BUYER irrevocably accepts and undertakes to transfer the full product price immediately to the SELLER's bank account without the need for further notice.
Any points granted to the BUYER by the SELLER through a campaign are valid for one purchase only. Such points will not be reinstated if the product is returned.
For payments made by credit card, the product amount shall be refunded to the relevant bank within 7 (seven) days following cancellation of the order by the BUYER.
The time required for the refunded amount to appear in the BUYER's account depends entirely on the relevant bank's commercial procedures and processing times. The BUYER acknowledges that the SELLER cannot intervene in potential delays and that the refund may take approximately 2–3 weeks to appear in the BUYER's account.
The records of the SELLER, including but not limited to computer and audio records stored in magnetic media, shall constitute evidence within the meaning of Article 193 of the Turkish Code of Civil Procedure No. 6100 in the resolution of any disputes arising from this Agreement and/or its implementation.
ARTICLE 5 – RIGHT OF WITHDRAWAL
The BUYER, acting as a consumer, may exercise the right of withdrawal within 14 (fourteen) days from the date of receipt of the goods by submitting written notice or notice through a permanent data storage medium to the SELLER.
The BUYER may exercise the right of withdrawal using the withdrawal form available on the website or by making an explicit statement declaring the decision to withdraw from the Agreement.
The consumer may submit the withdrawal notice to the address or e-mail address specified in Article 1.1 in a manner that enables verification of their identity.
The consumer must return the goods to the SELLER or its authorized representative within 14 (fourteen) days from the date on which the withdrawal notice is submitted.
The current shipping companies that may be used for returning the goods are specified on www.goldanalytixturkiye.com.
ARTICLE 6 – PRODUCTS EXCLUDED FROM THE RIGHT OF WITHDRAWAL
Pursuant to the Distance Contracts Regulation, unless otherwise agreed by the parties, the consumer may not exercise the right of withdrawal in the following cases:
a) Goods or services whose prices fluctuate depending on developments in financial markets and which are not under the control of the seller or service provider.
b) Goods prepared in accordance with the consumer's wishes or clearly personalized needs.
c) Goods that may deteriorate quickly or expire.
ç) Goods whose protective elements such as packaging, tape, seals or packages have been opened after delivery, where return is unsuitable for health or hygiene reasons.
d) Goods that, after delivery, become mixed with other products and cannot be separated due to their nature.
e) Books, digital content and computer consumables supplied in a tangible medium where protective elements such as packaging, tape, seals or packages have been opened after delivery.
f) Periodicals such as newspapers and magazines, except where supplied under a subscription agreement.
g) Accommodation, transportation of goods, car rental, food and beverage supply, and leisure activities for entertainment or recreation that must be performed on a specific date or during a specific period.
ğ) Services performed instantly in an electronic environment or intangible goods delivered instantly to the consumer.
h) Services which have commenced with the consumer's consent before the expiry of the withdrawal period.
ARTICLE 7 – DELIVERY TERMS

ARTICLE 8 – DEFAULT OF THE BUYER
If the BUYER defaults on their obligations, the BUYER agrees to compensate the SELLER for all damages and losses arising from the default and delayed performance of the obligation.
However, if the BUYER's default is caused by the gross negligence of the SELLER, the BUYER shall not be obliged to compensate any resulting damages or losses.
ARTICLE 9 – COMPETENT COURTS
In the implementation of this Agreement, where the BUYER is a consumer, Consumer Arbitration Committees and Consumer Courts located at the place where the BUYER purchased the goods or services and/or where the BUYER resides shall have jurisdiction up to the monetary limits announced by the Ministry of Trade of the Republic of Türkiye.
